In Knoxville, a local woman who had launched a federal class-action lawsuit against one of the largest Waffle House franchises, claiming improper pay, has chosen to dismiss her suit.
The employee, Colleen Knoski, had alleged that Rocky Top Waffles LLC, the franchise in question, had failed to properly compensate her for her work and had falsely reported higher wages in its payroll system. However, according to a court document, Knoski has decided to drop the lawsuit. The reason behind the dismissal has been attributed to some undisclosed “facts … regarding her employment” that the franchise provided. No further details have been provided in the filing.
Knoski, who was working as a server at the Cedar Bluff Road Waffle House in Knoxville at the time she filed the suit, accused Rocky Top Waffles of violating worker’s rights as per the Fair Labor Standards Act. She claimed that they had wrongfully deducted amounts from workers’ wages in a tip-share agreement and then reported a higher pay in their payroll system.
Rocky Top Waffles LLC is a registered corporation in Georgia but has its central offices in Chattanooga. It operates under the parent company Southern Legacy Waffles LLC, which is a Delaware-formed enterprise that manages other Waffle House franchises like Choo Choo Waffles LLC and Lookout Waffles LLC. According to its Facebook page, Southern Legacy Waffles is the country’s oldest and biggest Waffle House franchise, owning a whopping 76 stores – most of these are located in East Tennessee.
