Sponsor Our ArticlesKnoxville, TN – A Knoxville resident has been sentenced to prison for his actions during the January 6, 2021, incident at the U.S. Capitol. Michael Asbury, 44, faced legal consequences for his part in the events that led to the disruption of Congress as they were preparing to certify the electoral votes for the 2020 presidential election.
On Monday, the U.S. Attorney’s Office for the District of Columbia announced that Asbury was sentenced to four months in prison. After his time in jail, he will serve two years of supervised release, with the first four months of that being under home detention. Additionally, Asbury was ordered to pay $2,000 in restitution.
Asbury had initially pleaded guilty to a felony charge of obstruction of law enforcement during a civil disorder on March 20, 2024. His arrest by the FBI occurred a few months earlier, on June 28, 2023.
The court heard that Asbury traveled to Washington, D.C., along with his cousin to attend the “Stop the Steal” rally held at the Ellipse prior to the siege. Following the rally, the two made their way to the West Front of the Capitol. Video evidence presented during the proceedings captured Asbury climbing onto a media tower and later participating in the chaos at the Lower West Terrace and the Lower West Terrace Tunnel.
Asbury’s actions were particularly troubling as he was seen in footage joining his fellow rioters in **collective efforts** to push against police who were trying to protect the Capitol. He was documented taking part in a “heave-ho” effort, where rioters attempted to overwhelm law enforcement lines. After this confrontation, Asbury re-entered the tunnel to engage police once more and was even seen cheering on other rioters, which indicated his continued active participation in the riot.
The incident on January 6 resulted in serious repercussions nationwide, with the Department of Justice stating that its investigation into the Capitol insurrection is still ongoing. To date, more than 1,400 individuals from nearly every state have been charged in connection with the riot, including several from Tennessee.
This sentencing serves as a reminder of the seriousness of the events that unfolded that day and the ongoing commitment of law enforcement to hold individuals accountable for their actions.
